How to serve a Section 8 notice
The legal mechanics of getting Form 3A into the tenant's hands.
A perfectly drafted Form 3A served the wrong way is invalid. Service rules vary slightly with the tenancy agreement, but the safe defaults are well established.
Approved methods
Hand delivery to the property, ideally with a witness who can sign a statement.
First Class post to the property. Get proof of posting from the Post Office.
Email, but only if the tenancy agreement explicitly authorises email service of notices.
Proof of service
A signed statement from anyone who delivered the notice in person.
Royal Mail proof of posting receipt.
Email read receipts and saved sent items, plus the clause in the tenancy that authorises email.
Calculating the notice end date
Service is the day after delivery (or the second working day after posting). Add the notice period for the longest cited ground.
Common mistakes
- Posting without proof. If the tenant denies receipt, you have no answer.
- Email service without an authorising tenancy clause. Often invalid.
- Wrong notice end date. Fatal to the notice.
