Ground 11: Persistent late payment
Ground 11 covers tenants who persistently pay rent late, even where they catch up before the hearing. It is the answer for landlords whose tenants always settle eventually but never on time.
It is discretionary. The court will look at the pattern, the length of delay, and any reasonable explanation.
What you need
- A documented pattern of late payments. Bank statements, letters chasing rent, and a rent ledger help.
- A correctly completed Form 3A citing Ground 11 (often paired with Grounds 8 and 10).
Common mistakes
- One or two late payments are not 'persistent'. Most successful Ground 11 cases show a long-running pattern over many months.
- If you have ever accepted late rent without comment, the tenant may argue you waived the term. Send written reminders each time.
