Section 8 evidence checklist

A correctly served Form 3A is only the start. The court hearing is won and lost on the evidence file. Here is what experienced landlord solicitors recommend gathering before filing a possession claim.

Always include

Signed tenancy agreement.

Form 3A and proof of service.

Proof of deposit protection.

Proof you delivered the Information Sheet (relevant for ongoing tenancies).

Up-to-date contact details for every named tenant.

For rent arrears (Grounds 8/10/11)

Rent ledger (bank statements with rent receipts highlighted).

Written reminders sent to the tenant, dated.

Any payment plan correspondence.

If Universal Credit, evidence of housing payments status.

For breach or damage (Grounds 12/13)

Move-in inventory and condition report.

Photographic evidence with metadata.

Written warnings and the tenant's responses.

Repair quotes or invoices.

For ASB (Grounds 14/7A)

Witness statements from neighbours, signed and dated.

Police 101 logs and crime references.

Council ASB or noise team reports.

Court conviction documents (for Ground 7A).

For move-in or sale (Grounds 1/1A)

Evidence of intention: estate agent instruction, marketing letters, school registration, contracts of sale.
